Canvas USA® (“Canvas USA®,” “we,” “us,” or “our”) operates this store and website and provides all related information, content, features, tools, products, and services (collectively, the “Services”) to give you a curated shopping experience. The Services are hosted and supported by Shopify, which enables us to provide the Services to you.

7) Photographs, Drawings, Designs, and User-Submitted Content

The Services may allow you to submit, upload, or share content, including photographs, images, videos, drawings, sketches, designs, measurements, patterns, reviews, comments, and other materials (collectively, “User Content”). User Content may include personal information and may be visible to others depending on where and how it is posted.

A. Content You Submit

If you submit User Content to us (including photographs of your boat, vehicle, home, installation site, finished project, or any other property; drawings, sketches, or design concepts; or any similar content), you represent and warrant that:
  1. You own the User Content or have all necessary rights and permissions to share it with us;
  2. the User Content does not violate any third-party rights (including privacy, publicity, copyright, or trademark rights); and
  3. You have obtained permission from any person who appears in the User Content to use the User Content as described below.

B. Ownership and Rights Granted to Canvas USA®

You retain ownership of your User Content. However, to the maximum extent permitted by law, by submitting User Content to Canvas USA®, you grant Canvas USA® and our affiliates, partners, and service providers a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, store, host, display, publish, distribute, transmit, modify, edit, translate, create derivative works from, and otherwise exploit your User Content in any media and for any lawful purpose, including without limitation:
  • fulfilling orders and providing customer service;
  • verifying, investigating, and processing returns, exchanges, or warranty claims;
  • product development and improvement;
  • marketing, advertising, promotional materials, website content, catalogs, emails, social media, and other communications;
  • training internal staff and improving support and quality;
  • fraud prevention, dispute resolution, and enforcement of our policies.
This license includes the right to use your User Content with or without your name, handle, or other attribution, and without compensation to you, unless required by law.
To the fullest extent permitted by law, you waive any moral rights, privacy rights, publicity rights, and similar rights in the User Content, and you agree not to assert or enforce such rights against Canvas USA® or its affiliates, partners, or service providers for any use of User Content permitted under this Privacy Policy and our Terms of Service.

C. No Expectation of Confidentiality

Do not submit User Content that you consider confidential or proprietary. User Content will not be treated as confidential, and we are not responsible for protecting it as confidential unless we separately agree in writing.

D. Creative Materials and Ideas (Drawings, Designs, Concepts)

If you submit drawings, sketches, measurements, patterns, or project concepts, you understand that we may already be working on similar ideas or may develop similar products or solutions in the future. You agree that we may use, adapt, and apply the general concept, approach, or ideas reflected in your submission without restriction, and without any obligation to you, subject to applicable law.

E. Content Collected From Public Platforms

If you post User Content on third-party platforms (such as social media) and tag us, mention us, use a Canvas USA® hashtag, or otherwise direct the content to us, we may collect and use that content as described above, consistent with the platform’s privacy settings and terms.

F. Removal Requests

If you want us to stop using specific User Content for marketing or promotional purposes, you may contact us at Shop@CanvasUSA.com with sufficient information to identify the content. We will consider requests and will comply where required by law; however, we may retain copies for recordkeeping, legal, security, fraud prevention, or operational purposes.

G. Release of Liability and Indemnity

To the fullest extent permitted by law, you release, waive, and forever discharge Canvas USA®, and its owners, officers, directors, employees, agents, contractors, service providers, affiliates, successors, assigns, and advertising and marketing partners (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
  • our use of your User Content as permitted by this Privacy Policy and our Terms of Service;
  • any alleged infringement or violation of your rights or the rights of any third party in connection with the User Content, including claims for invasion of privacy, infringement of publicity rights, defamation, misappropriation, moral rights, or emotional distress;
  • any failure by you to obtain required permissions, releases, consents, or licenses from any person or third party appearing in or owning rights in the User Content; and
  • any dispute regarding ownership, attribution, or compensation for use of the User Content.
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all third-party claims, demands, actions, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to the User Content you submit, including any allegation that the User Content violates any law or infringes the rights of any person or entity.
This section survives any deletion of User Content and survives the termination of your relationship with Canvas USA® or your use of the Services.

8) Shopify’s Role

The Services are hosted by Shopify. Shopify collects and processes certain information about your access to and use of the Services in order to provide and improve Shopify’s platform and related services. Information you submit through the Services (such as order and account information) may be transmitted to Shopify and to third-party service providers supporting the Services, including providers located outside your country of residence.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we sell or share (as those terms are defined under applicable law) personal information of individuals under 16 years of age.
